The present terms & conditions of sale are solely valid for the sale of products commercialized on this Website by QLARITÉ (hereafter to be referred to as the “Products” and individually as the “Product”). They will be systematically accessible on the Website by every potential purchaser (hereafter to be referred to as the “Customer”) at the moment of validating an order.

We invite you to read the description of each Product to know its characteristics.

In consequence, by placing an order, implicates acceptance of these terms & conditions of sale excluding all other conditions.

1. Offers and prices

The promotional offers are only valid for the duration of the concerned commercial offer.

Products prices displayed are exclusive of all taxes and duties. As the recipient, you are liable for all import duties, customs and local sales taxes levied by the country you are shipping to; payment of these is necessary to release your order from customs on arrival. As we are unable to advise the amount this may be, we will always seek your confirmation by email prior to dispatching the order. Please look out for this email to ensure timely dispatch of your order.

The prices indicated on the Website are guaranteed until the final date of validity which may be specified in the offer and within the limits of available stocks.

Products will remain the property of QLARITÉ until complete payment of the QLARITÉ given price.

2. Prohibition To Sell Out Of Networks

Our Products are solely intended to be sold through our distribution networks. Consequently, any sale, purchase or prize giving of our Products with the purpose of reselling outside of our networks, namely through websites, are forbidden. Regardless of any damage to the reputation of the brand or the integrity of our Products, such reselling of our Products shall be likely to engage the civil and, if need be, penal liability of its authors.

3. The Order Process

The different steps of placing an order are as follows: You select the Product(s) of your choice and add them to your shopping basket, you can at any moment check the Products in your shopping basket, the price and apply any modifications (confirm or correct) prior to finally placing your order. You log-in (with your email and password). If you are a new Customer, you have to create an account and you then must log-in by entering a valid email address and a password (personal and confidential) that will be asked throughout the Website.

Then, you will be first guided to a page in order to confirm your email and your billing information and then automatically guided to the payment page. You will be invited to choose your shipping method and the payment method from those offered and to confirm these.

The supply of your personal information is compulsory for the treatment and delivery of your order. When you confirm your order by clicking on the button “Validate”, you declare to have accepted these and all the terms and conditions. Your order is then treated by our Customer Service department. Once your order has been placed, we will send you an automated email acknowledgement, to your given email address, providing you with a detailed summary of your order and the total and final price charged the amount to be invoiced and the delivery address you opted with. This is not an order acceptance from QLARITÉ.

We do although, reserve the right to cancel all orders with a Customer that has an outstanding payment or with whom we are in legal proceedings regarding a payment of a previous order, or for any other lawful reason namely to the unusual nature of an order.

4. Product Availability

Our Product offers proposed on the Website are only valid while stocks last. In the case where a Product does become unavailable, after you have placed an order, we will do our utmost to advise you within a delay of eight (8) working days and to give you the date at which you will receive the Product. If you prefer you may cancel your order (QLARITÉ will refund you within a delay of fifteen (15) working days) or ask for the exchange of an order by contacting us by email: sales@qlarite.com. In the case where a Product does become unavailable, QLARITÉ will reimburse you, unless we would be able to send you a substitute (necessarily a Product of equivalent quality and commercial value); if this Product does not suit you, you can return it to us within a delay of ten (10) working days and we will refund you for your Product and postal return fees (within a delay of twenty (20) working days).

5. Payment

The payment of your purchases on the Website is exclusively in Euros.

QLARITÉ proposes different payment methods as credit card or Paypal. The order value will be debited at the time of placing your order.

6. Delivery

Please allow up to 24 hours to process your order in addition to shipping time.
Once the order is prepared, it will be send at the postal address given by the Customer when he/she placed his/her order.

An order confirmation e-mail containing your order details will be sent immediately after your purchase.

A shipping confirmation e-mail containing your tracking information will be sent within 24 hours of when your order has been shipped.

The Products are delivered by DHL (hereafter he “Transporter”). The Customer is informed that the Product can be kept for a limited period of time after its first unsuccessful delivery (see the General Terms of the Transporter).

QLARITÉ will do its best efforts to respect a 24 hours delay to treat your order. Sundays and bank holidays are not working days.

The maximum shipping delay is thirty (30) working days from the day after the date of the confirmed order provided the price of the Product is fully paid in conformity with the present General Terms and Conditions of Sale. If the Product is not delivered with this delay, the Customer will be free to cancel its order.

In case of exceeding the maximum delivery time of thirty (30) working days, the Customer may exercise its right of termination of the order to the Customer Service.

Is such is the case, QLARITÉ shall immediately reimburse the Customer (delivery costs included) via one of the payment method from those that are offered by QLARITÉ and no later than thirty (30) days after cancellation of the order by the Customer, without further indemnification.

The Customer should inform by e-mail QLARITÉ as soon as possible of any late delivery in order for QLARITÉ to be able to have an enquiry made by the Transporter. The Customer is informed that the enquiry may take time, and that QLARITÉ has no mean to control the Transporter’s enquiry proceedings. If the Product is located as a result of the Transporter, it will be immediately sent to the address specified in the order; If the Product appears to be lost after the enquiry, the Customer shall contact QLARITÉ and either chooses to have the Product sent again or to be reimbursed via one of the payment method from those that are offered by QLARITÉ . In case the Customer does not contact QLARITÉ with thirty (30) days, the order will be reimbursed. Each delivery is deemed to be completed when the Product is presented by the Transporter to the Customer. The Customer is responsible to immediately inspect the conformity and integrity of the Product.

Any anomaly or reserved noticed at delivery (notably in case of late delivery or missing Product or damaged Product) should be expressly and precisely mentioned by the Customer on the Transporter receipt at the time of the delivery, and confirmed by registered mail to the Transporter within a three (3) days after the delivery. Any such anomaly or reserve as to the state of the Product should be as well notified to QLARITÉ Customer Services, with a copy of the claim made to the Transporter.

7. Right To Cancel – Satisfaction Guaranteed Or Refunded

Making a return or exchange is easy. Just make sure you request a Returns Merchandise Authorization (RMA) number and send your Product(s) back to us within fourteen (14) working days from the date of the delivery. This right of withdrawal can be exercised without the Customer incurring any additional costs, except for return postage fees.
The procedure is as follows:

  1.  Sign into your account and under “My Orders”, select the order number containing the Products you would like to return.
  2. Click on the “Create a return” button and choose the reason why you want to send your Product(s) back. If a Product is faulty, please provide details why and you can request an exchange.
  3. To request a refund, select how you would like to be credited. This needs to match the original payment method used.
  4. Check the box to agree with our Return Policy. You will then receive an email containing your RMA number and a printable return slip.

Please send us back the Product unused, in the original packaging with the return slip to the following address [•] Returns without an RMA will be returned to sender.

8. Important Information

All Products are quality controlled and checked for any faults before they are dispatched to Customers. Should you receive a Product that is not in perfect condition please contact us immediately.

Please send all Products you wish to return from an order in the same shipment to ensure your return is processed as quickly as possible and is adequately protected.  The Products must be in perfect condition and must not have been used or have suffered damage of any kind.
Your return may not be accepted if the box is damaged.
Free collection does not apply. We prefer that Products are returned to us via DHL to ensure that they are protected and insured during transit. However, you may return the goods by any secure means.

9. Warranties

You benefit the legal guarantee of our delivered Products. We ensure your consumer rights and the respect of the general requirements of professional diligence, in particular regarding manufacturing or our Products, e-commerce and Direct Marketing.

Your QLARITÉ Product is warranted to be free from defect in material and workmanship for a period of two (2) years after its original purchase date under normal use. This warranty extends only to the original retail Customer with original proof of purchase and only when purchased from an authorized QLARITÉ online shop or retailer or reseller.

  1. The warranty is valid with the buyer’s original proof of purchase, such as an invoice, receipt, or warranty certificate issued by QLARITÉ , along with the receipt or proof of credit card payment if the purchase was completed online. The proof of purchase must indicate the purchase date, the Product description, and (if applicable) the serial number. QLARITÉ reserves the right to freely deny the warranty if the documents identified above are not provided or if the information required is incomplete or illegible.
  2. The warranty period lasts two (2) years from the date the buyer purchased the Product from QLARITÉ .
  3. During the warranty period, QLARITÉ will repair or replace the defective Product, free of charge, at its sole discretion while supplies last. QLARITÉ will return the repaired Product to the Customer or supply another Product in good working condition. All parts and other exchanged materials shall become the property of QLARITÉ .
  4. The warranty period shall not be extended or renewed for a repaired or replaced Product.
  5. The warranty applies to defects that arise in the use of the Product in compliance with the operator manual.

It does not cover maintenance, repairs, or the replacement of parts due to the Product’s normal use or age. Specifically, the warranty does not apply when:

a. The defect was caused by the fact that the Product was subjected to: use in contradiction to this operator manual, rough handling, exposure to excessive moisture, extreme thermal or environmental conditions, or rapid change in such conditions, exposure to corrosion, oxidation, unauthorized modifications or connections, unauthorized repairs or repairs performed by the buyer himself, repairs performed with unauthorized spare parts, misuse, improper power, noncompliance with the installation instructions, incorrect installation, an accident, forces of nature, contact with liquid, the action of chemical products, and other acts that are reasonably beyond the control of QLARITÉ .
b. The buyer does not notify QLARITÉ of the defect within thirty (30) days of the defect’s appearance during the warranty period;
c. The Product is not returned to QLARITÉ within sixty (60) days of the defect’s appearance during the warranty period;
d. The Product’ s serial number or any other identification number has been removed, erased, damaged, altered, or is no longer legible;
e. The defect results from the fact that the Product was used with an accessory that was not made or provided by QLARITÉ .

i. The buyer agrees to return the Product in its original packaging. QLARITÉ is not responsible for any damage to the Product caused by it being shipped in the wrong packaging. QLARITÉ reserves the right to request a flat charge from the buyer to cover Product shipping charges.

ii. The warranty constitutes the buyer’s sole and exclusive remedy against QLARITÉ and QLARITÉ ‘s sold and exclusive responsibility to the buyer for Product defects. The warranty replaces all other warranties or liabilities, whether oral, written, legal (unless mandatory), contractual, or otherwise. QLARITÉ is not responsible for damages or incidental, consequential, or indirect costs. Any changes to the warranty shall require the prior written consent of QLARITÉ.

9.1 Warranty for Products sold on the Website

All of our Products are covered against manufacturing defects. Defective Products must be returned for inspection at the buyer’s expense, to determine the validity of the claim. The Product receipt is required in order to qualify for the Product warranty. If any defects are found, the Product will be refund to the buyer or exchanged, depending on the buyer’s preference and while supplies last. If a refund is required, it must be carried out within fourteen (14) days of receiving the buyer’s returned Product. Return costs may then be refunded with proper proof.

The buyer shall be entitled to the legal warranty for hidden defects, as defined under Articles 1641 et seq. of the French Civil Code.

QLARITÉ reserves the right to make changes and improvements to its Products without incurring any obligation to incorporate such improvements in Products previously sold.

10. Responsibility

Products proposed are in conformity with French regulations.

QLARITÉ will not be held responsible for non-delivery of orders in case of out of stock Products, natural disaster, postal strikes/problems or delivery service provider strikes/problems. QLARITÉ will not be responsible for any indirect damages after the following: loss of exploitation, loss of profit, damages or costs.

QLARITÉ does not sell to minors. If you are under the age of 18, you may browse our Website. However, you may not provide personal information to us. For example, you cannot register or make a purchase. This Website is not designed for minors and we do not knowingly collect personally identifiable information from any person under 18 years of age. Consequently, orders intended for minors require the authorization by a parent or a legal guardian.
In case of accidental collection of minor personal data, the parental authority has the capacity to refuse the retention or/and transfer of data to a third party.

The Website may contain links from other websites. Please be aware that we are not responsible for the privacy practices as well as the contents of other websites that may be contradictory with French laws and legislations.

In other respects, QLARITÉ would like to remind you that all links to the Home Page or any other pages of the Website are to be subject to prior and written acceptance by QLARITÉ .

11. Respecting Mankind And Nature

For your comfort and safety our skin care Products are guaranteed hypoallergenic and all our Products are tested in laboratories.

12. Legal Notice

The present contract abides the French law. The language for the conclusion of the present contract is, French, its English translation is for convenience only. Your use of this Website and any purchase you make of any goods from QLARITÉ shall be governed by French law and be submitted to the exclusive jurisdiction of the French courts.

13. Modifications Of The General Terms & Conditions Of Sale

Considering the evolution of the Website, QLARITÉ reserves the right to adapt or modify at any moment the present terms & conditions of sale. The new terms & conditions of sale will be made available to the Customer via the modification of the online information on this Website and will be put into practice on orders validated after the date of modification.
